Terms of use of the online store
These Terms of Use are an integral part of the distance contract, which the parties, based on the customer's order, enter into at the Internet point of sale www.gardeners.lv. The obligations contained in the Terms of Use are mandatory. Violation of these Terms of Use may result in termination of the distance contract. The contract is valid indefinitely.
By placing an order, the customer confirms that he has read, understood and agrees to the Terms of Use. The customer is not allowed to order goods from our online sales site www.gardeners.lv if the customer has not read and agreed to the Terms of Use.
Distance contract
Sabiles Sidrs SIA (reg. No. 40103236262, license no. MT00000010042), legal address Siguldas pr. 33, Rīga, LV-1014, in the person of its board member on the one hand, hereinafter referred to as the Seller, and the person who places an order in the Gardener's (www.gardeners.lv) online store and has confirmed that he/she agrees with the terms of their agreement, hereinafter referred to as the Buyer on the other hand, shall conclude the following Agreement:
The Seller undertakes to sell and deliver the goods offered by Gardener's to the Buyer, hereinafter - the Goods, upon the electronic request of the Buyer. The buyer undertakes to present an identity document at the time of delivery.
1. Ordering
1.1 By placing an order in the Gardener's online store, the Buyer confirms that he is an able-bodied person who has reached the age of 18 and is entitled to shop in the online store.
1.2. When ordering goods, the Buyer is responsible for providing true and correct information by filling in the information fields of the order form.
1.3. The Seller reserves the right to contact the Buyer in connection with the order, the information provided by the Buyer or its absence, as well as to suspend and cancel the order in case of discrepancies or violation of the rules.
1.4 The Buyer's personal data will be used for ordering and delivery, preparation of invoice documentation, refund of the overpaid amount and returned goods, administration of financial obligations and other obligations arising from these Terms of Use and distance contract, as well as other services provided by the Seller. For more information on the processing of personal data, please see section 10 of the distance contract.
2. Price, payments and delivery costs
2.1. Product prices in Gardener's store are indicated in EUR. All prices are inclusive of any value added tax or other tax. The goods are sold at the prices valid at the time of creating the order. The bank fee may apply depending on the bank used by the customer.
2.2. In addition to the Purchase Price, the Buyer must also pay the delivery fee for courier delivery services to the specified address. Courier costs depend on the amount of goods ordered.
2.3. The customer can pay only with the payment methods specified in the online store's payment methods menu. Execution of the order is started only when the Seller has received the payment or a document confirming it.
2.4. After receiving the order, the Seller will send the Buyer an e-mail confirmation of the purchase.
3. Product collection and delivery
3.1. The Seller makes every effort to ensure that the information provided in the Gardener's Online Store regarding the selection of products and their availability is correct and true. The Seller allows the possibility of a situation in which certain goods ordered by the Buyer are not available at the time of order fulfilment (contrary to what is indicated in the Online Store). In this case, the Seller shall contact the Buyer to agree on the adjustment of the Purchase in accordance with the Buyer's wishes and the Seller's capabilities.
3.2. Delivery will be made to the address specified by the Buyer at the time of placing the order. The courier delivers the purchase to the address specified by the Buyer and hands it over to the Buyer, first asking for an identity document.
3.3. Delivery can be received by an adult who is at least 18 years old and has presented proof of age. If proof of age is not available and there is no one over the age of 18 at the time of delivery, the products will remain with the supplier.
3.4. In cases when the courier delivers the Buyer's order at the specified time, but there is no one at the address who will be able to receive the order, the Buyer will be informed and the Picasso will need to contact us to agree on a new delivery time. In such cases, if the Seller has to return the order, the Buyer may be required to pay an additional fee for re-delivery.
3.5. The Seller makes every effort to ensure that the Buyer's order is delivered within 2 business days, the Seller accepts no responsibility for non-compliance with this time in part or in full, if this deviation is due to the Buyer or other unavoidable circumstances.
3.6. Orders are not processed and Purchases are not delivered between 22.00 and 08.00, in accordance with the restrictions on the sale of alcohol in the law of the Republic of Latvia.
4. Quality guarantee and responsibility
4.1. The seller guarantees the manufacturer's quality for Gardener's Internet but does not guarantee the complete visual conformity of the delivered goods to the images displayed online. The images displayed in the online store are illustrative and informative.
5. Right of withdrawal and cancellation of the order
5.1. The Seller reserves the right to cancel the execution of the Buyer's order in case the conditions of using the Online Store are not observed and the Buyer has violated the distance contract in any way. In case of such a decision, the Seller shall immediately inform the Buyer by sending an informative message to the e-mail address provided by the Buyer.
5.2. According to the current legal terms of the Distance Agreement, which can be viewed on the Center for Protection of Consumer Rights (PTAC) website:
5.2.1. The buyer has the Right to Refuse (meaning - cancel and return) an online purchase within 14 days after delivery of the goods.
5.2.1.1. This Right to Refuse can be used even if the delivered goods are complete, undamaged and correct.
5.2.1.2. The customer is eligible for a refund of the full value of the goods (full refund) as long as the packaging or the product has not suffered minor or significant damage. The opening of an opaque bottle case, which is necessary to view the goods in the same way as is possible in a physical store, is considered Insignificant Damage and the product is eligible for a full refund. The kind of damage that reduces the value of the product, but does not exclude the possibility of selling the product to another buyer is considered Minor Damage. Damage to the product's packaging or product itself that compromises the integrity of the product and the possibility of returning the product to circulation is considered Significant Damage. In the case of minor or significant damage, the Seller maintains the right to reduce the value of the goods by up to 100%.
5.2.2. In order to exercise the Right to Refuse, we ask the buyer to submit a completed Withdrawal Form, which can be obtained upon request from the Seller. The form can be requested by contacting the company by phone or e-mail.
5.2.3. The Seller returns the money to the buyer for the rejected item in accordance with the procedure established by PTAC, reserving the right to reduce the value of the item (and thus the amount of money to be returned) in case of minor or significant damage.
5.2.3. In accordance with PTAC regulations, using the Right to Refuse, the Buyer is obliged to cover the costs incurred to return the item to the Seller.
5.3. If the Buyer has found after receiving the order that the Product is incorrectly assembled, damaged and/or of poor quality, the Buyer applies to the Seller with an application in free form, to which they attach a photo of the damaged product and data for identifying the purchase. The buyer has the right to request a refund for the defect, or an exchange for an equivalent product, upon agreement with the Seller.
5.4. The Seller reserves the right to temporarily or completely stop e-commerce without prior notification to buyers. In such cases, the Seller fulfils the orders made before the suspension of trade or, if the fulfilment of the order is not possible, reimburses the Buyer for the undelivered orders within 10 working days.

7. Final provisions and dispute settlement
7.1. SIA Sabiles Sidrs may unilaterally make changes to these Terms of Use.
7.2. These Terms of Use have been prepared in accordance with the laws and regulations of the Republic of Latvia and all disputes are subject to the courts of the Republic of Latvia.
7.3. If the Buyer considers that SIA Sabiles Sidrs has violated these Terms of Use or other applicable laws and regulations, and this has affected the Buyer's ability to exercise its rights and it is not possible to resolve such a situation in mutual negotiations, the Buyer may apply to the national consumer protection authority - Consumer Rights protection centre.
8. Data processing and protection
8.1. The Buyer's personal data will be used to identify the Buyer and receive the order, place the order and delivery, prepare the accounting documents, including the invoice, refund the overpaid amount and return the returned products, administer financial obligations and other obligations arising from these Terms of Use and distance contract, as well as for the use of services offered by SIA Sabiles Sidrs.
